O’Melveny’s Simmons Quoted in Policy and Regulatory Report on Class Certification, Daubert Hearing in Price-Fixing CaseMarch 05, 2014
O’Melveny & Myers partner Ian Simmons was quoted in a March 5, 2014, Policy and Regulatory Report article, titled “US Steel, Gerdau, and Six Other Producers Fight Class Certification in Price-Fixing Case.” Class certification and “Daubert” hearings on the admissibility of expert testimony represent a crucial stage in antitrust class action cases, according to the article. “As plaintiffs and defendants, and indeed the courts have recognized, the class certification decision in antitrust cases demands considerable factual and economic scrutiny by all involved, and thus is a critical phase of the litigation,” Simmons said in the article. He added that a court’s ruling on antitrust class certification can decide the outcome of a case.
Simmons is a member of O’Melveny’s Antitrust and Competition Practice, and resides in the Firm’s Washington, DC office.
