O'Melveny's Victory in Securities Fraud Case Noted in Multiple PublicationsDecember 14, 2013
O’Melveny & Myers’ defeat of the Securities and Exchange Commission in an alleged securities fraud case against former Basin Water CFO Thomas C. Tekulve received coverage from several outlets, including Law360, the Daily Journal, The National Law Journal, and AmLaw Litigation Daily.
O’Melveny partner Carolyn Kubota was quoted in the December 13, 2013, AmLaw Litigation Daily piece regarding the ruling. The SEC “really just mis-assessed the nature of the conduct," she said in the article. “Not every mistake is negligent, and not every mistake is a securities fraud.”
Kubota is a member of O'Melveny's Business Trial and Litigation Practice as well as the White Collar Defense and Corporate Investigations Practice. The Los Angeles-based O’Melveny team also included partner Seth Aronson and associate Alec Johnson, who are members of the Firm’s Securities Litigation Practice.
