Rapisardi, Zujkowski Co-Author New York Law Journal Article on Uncertainty in Key Chapter 15 Issue

January 07, 2014 O’Melveny & Myers partner John Rapisardi and counsel Joseph Zujkowski co-authored a New York Law Journal article, titled “Conflicting Decisions Create Uncertainty on Key Chapter 15 Issue.”  The January 7, 2014, article focuses on the question of whether a foreign debtor must have assets located in the United States in order for a US bankruptcy court to “recognize” its foreign insolvency proceeding under chapter 15 of the US Bankruptcy Code.  The authors discuss two conflicting decisions reached by the US Court of Appeals for the Second Circuit and the US Bankruptcy Court for the District of Delaware in the piece.

Rapisardi is co-chair of O'Melveny's Global Restructuring Practice, of which Zujkowski also is a member. They reside in the Firm’s New York office.
