Reuters: JPML Rejects Nationwide Consolidation of Business Insurance Cases. Now What?

O’Melveny partner and Litigation Department co-chair Richard Goetz is quoted in this Reuters article on the Judicial Panel on Multidistrict Litigation’s decision to deny two motions that would have consolidated hundreds of suits by policyholders whose insurers have denied their claims stemming from COVID-19-related business closures.

Goetz, the lead lawyer for the insurers, argued against consolidation and encouraged the MDL panel to allow judges to rule quickly. He noted that decision not to create a nationwide MDL means judges can start to issue decisions on insurers’ dismissal and summary judgment motions in individual cases. “The litigation will proceed more quickly than it would have in an MDL,” Goetz said.
