Publicity rights cases involving video games have brought distinctly different rulings than fantasy cases. When it comes to video games, the courts have more often sided with the players and the player unions. Alternatively, courts side with game operators when it comes to fantasy leagues. 

Irwin Raij, sports practice group co-chair at O’Melveny, recently created a cross-disciplinary committee of lawyers from various domains to address the new legality of sports betting. 

“I created a task force at the firm because I think it’s much deeper than saying: ‘We’re going to have gambling. Yay! Everybody’s going to make money,’” Raij said. “There’s a complex set of issues that are pretty interwoven at times."
