O’Melveny is representing lawyer turned Hollywood movie producer Peter Hoffman in his bid to overturn a conviction for defrauding Louisiana’s movie tax credit system. Originally, Hoffman was sentenced to 60 months of probation, which was a significant departure from federal sentencing guidelines that recommend between 168 to 210 months in prison.
In response to the verdict, the Fifth Circuit Court of Appeals stepped in and vacated this sentence in favor of a harsher punishment. Now facing about 15 years in prison, Hoffman, his wife, and his attorney have petitioned the Supreme Court for review. The petition, filed by O’Melveny, argues that this case would “provide much needed clarity and uniformity for criminal defendants, prosecutors, and courts alike.”
