The New York Times’ “The Daily”: The Supreme Court Rules From Home

O’Melveny special counsel Jeff Fisher was quoted in this episode of The New York Times podcast, “The Daily,” which discussed the firm’s US Supreme Court win in Ramos v. Louisiana. The Court ruled that the US Constitution bans non-unanimous jury verdicts in cases involving serious crimes. The decision affects defendants and prisoners in Louisiana and Oregon, the only states that have allowed such verdicts in recent years. As the Times noted, both states have acknowledged the practice, which dates back to the 1890s, has roots in white supremacy.

“If you have one or two members of a minority on a jury—it could be a racial minority, it could be a political minority, it could be a religious minority—are we really prepared to say that those one or two votes can be utterly canceled out,” Fisher asked in his oral arguments.
