Mealey’s Daily News: Judge: Tribe Has Rights to Groundwater Pores, But Not Quantity, Quality of Water四月 29, 2019
On April 19, a federal California judge ruled that a Native American tribe has standing to seek declaratory relief for pore space under its reservation. However, the tribe lacks standing to assert a claim for quantification of the groundwater that it is entitled.
The ruling is the latestturn in a six-year case between the Agua Caliente Band of Cahuilla Indians, who in 2013 sued O’Melveny client the Coachella Valley Water District and the Desert Water Agency in the U.S. District Court for the Central District of California.
Coachella Valley is represented by partners Matthew Kline, Daniel Suvor, Walter Dellinger, and Anton Metlitsky. Of counsel Barton “Buzz” Thompson and counsel Bradley Garcia are providing support on this matter.
