WASHINGTON, DC -- APRIL 18, 2011 -- O’Melveny & Myers LLP scored a significant victory for client Asiana Airlines in obtaining the dismissal of state law treble damage antitrust claims. 

 

In the attached opinion issued from the US Court of Appeals from the Ninth Circuit on Monday, April 18, the opinion deals with the question of first impression, namely whether the Airline Deregulation Act applies to Foreign Air Carriers, such as Asiana Airlines.  The Circuit’s ruling affirmed the dismissal of state law claims, resulting in the dismissal of hundreds of millions of dollars of state law treble damage antitrust claims.  The court’s ruling also affirmed that the claims lack appellate jurisdiction over the state law plaintiffs' attempt to challenge a Case Management order assigning them their piece of the case.
