O’Melveny Prevails in Appeal for Top Victory Electronics in Hitachi Patent Dispute Case

LOS ANGELES -- September 15, 2014 -- O’Melveny & Myers LLP prevailed in an appeal before the United States Court of Appeals for the Federal Circuit brought by Hitachi Consumer Electronics Co Ltd. in a complex patent infringement lawsuit against O’Melveny’s client, Top Victory Electronics Co. Ltd. of Taipei, Taiwan.  Top Victory prevailed at trial in April 2013 before a jury in the Eastern District of Texas, defeating all of Hitachi’s claims and invalidating two of Hitachi’s asserted patents.  The underlying technology relates to broadcasting, receiving, adjusting and recording digital television signals.

The three-judge panel today affirmed the trial court judgment.

“We are pleased that the Federal Circuit today has affirmed the judgment entered following the Marshall, Texas jury’s verdict.  The case was a complex, technical one of significance to the digital television manufacturing industry, and we are pleased to see that our client’s position has been fully vindicated by a jury, the trial judge, and now by the Federal Circuit Court of Appeals,” said Mark Samuels, vice chair of O’Melveny.
