LOS ANGELES -- JUNE 12, 2012-- O’Melveny & Myers LLP announced that Carol A. Abernathy has rejoined the Firm as a counsel. Abernathy will be a member of the Firm’s Health Care and White Collar Defense and Corporate Investigations Practice Groups and will reside in O’Melveny’s Los Angeles office.
Abernathy’s practice will focus on the representation of health care industry clients in complex litigation and regulatory matters, including representing managed care companies and employer benefit insurance companies in nationwide class action litigation. She has represented pharmaceutical and medical device companies, hospitals, and other health care providers in a variety of civil and criminal matters, and has advised companies regarding various health care compliance issues, including state and federal anti-kickback laws, Medicare and Medi-Cal reimbursement, and the implementation and management of provider compliance programs.
Abernathy joins the Firm from O’Melveny client Advanced Bionics LLC, a global leader in the development of cochlear implant devices, where she served as associate general counsel and subsequently as senior quality systems director for six years. In that capacity, she was responsible for legal and regulatory compliance, including quality system compliance with US Food & Drug Administration (FDA) and international regulatory requirements for implantable medical devices. Abernathy began her legal career as a summer associate at O’Melveny and practiced at the Firm for almost six years.
“Carol’s hands-on industry experience and in-house perspective will be an asset to our health care clients as we provide them with comprehensive counseling on a wide range of business and legal issues,” said David Deaton, Co-Chair of O’Melveny’s Health Care and Life Sciences Practice and a member of the White Collar Defense and Corporate Investigations Practice.

Abernathy received a B.A., with honors, in 1981 from Manchester University and a J.D., magna cum laude, in 1999 from Southwestern University School of Law where she was lead articles editor for the Southwestern Law Review.
