LOS ANGELES, CA --  July 16, 2010 -- The Daily Journal has named O'Melveny & Myers LLP partners Apalla Chopra, Robert Siegel, and Fram Virjee to its 2010 list of California's leading labor and employment lawyers. In its July 14 Labor & Employment supplement, the Daily Journal discusses the "cutting-edge" work that earned Chopra, Siegel, and Virjee a spot on its collection of the "very top practitioners in the field." Chopra and Virjee are listed among the top employment defense lawyers, the "California lawyers companies turn to first," and Siegel is cited as one of just six labor practitioners "at the forefront of a renewed old practice."


Chopra represents clients across a broad range of industries in cases regarding employee allegations of wage-and-hour violations, invasion of privacy, wrongful discharge, and discrimination, and has extensive experience representing both employers and amici in significant trial court and appellate cases. Last year, Chopra won a demurrer significantly limiting the scope of a wage-and-hour class action lawsuit seeking to cover a sizeable California-wide class of non-exempt employees brought against a leading provider of pharmaceutical care for seniors. Chopra also achieved victories for DIRECTV in two putative wage-and-hour class action lawsuits involving a case of first impression in California, convincing the courts that release agreements could be enforced in the wage-and-hour context and thereby providing employers with a new defense in such lawsuits.


Siegel focuses his practice on the representation of airlines, as well as major companies in other industries. He represents several major airlines in employment law litigation and counseling, and also in labor negotiations, National Mediation Board matters, arbitrations, and litigation under the Railway Labor Act. In 2009, Siegel won victories for Midwest Airlines in a series of arbitrations against the Air Line Pilots Association (ALPA) and the Association of Flight Attendants, and successfully represented Spirit Airlines in a suit brought by ALPA under the Act for alleged bad faith bargaining and interference with ALPA's organization rights. He also obtained the dismissal of a complaint filed by ALPA against clients US Airways Group Inc. and US Airways Inc. alleging that the Act required a multiparty arbitration board to obtain preferential hiring at US Airways for the pilots it represents at other airlines.


Virjee, Chair of O’Melveny's Labor and Employment Practice, represents employers in employment-related multiparty and class action litigation, collective bargaining negotiations, and arbitrations, and before state and federal agencies. Last year, Virjee defended Ampersand Publishing in a petition brought by the National Labor Relations Board on behalf of newspaper reporters who unionized to gain editorial control of the Santa Barbara News Press from the new owner and editor. His efforts convinced a US District Court judge and 9th Circuit panel that the union's organizing efforts violated the owner's First Amendment rights to control editorial content of a paper. Virjee also represented Citigroup Global Markets in statewide and nationwide wage-and-hour class actions--consolidating seven cases into one jurisdiction and negotiating a settlement that limited liability for Citigroup, and secured denial of class certification and the granting of summary judgment for General Dynamics Information Technology Inc. in a wage-and-hour class action challenging exempt status, unpaid overtime, and missed meal and rest breaks.
