Daniel Lautzenheiser is a litigation associate in the Washington, DC, office. He rejoined the firm after clerking for the Honorable James A. Wynn, Jr., of the US Court of Appeals for the Fourth Circuit. Previously, he also clerked for the Honorable Thomas D. Schroeder of the US District Court for the Middle District of North Carolina.

He has worked on a range of matters across multiple fields including antitrust, product liability, and white collar defense. He has also co-authored briefs before the US Supreme Court and the US Court of Appeals for the Fifth Circuit.  

  • Part of a team that defended Google in four antitrust cases brought by a game developer, putative classes of consumers and app developers, and state attorneys general challenging Google’s policies regarding the Google Play Store
  • Part of a team that defended Johnson & Johnson in multiple state suits stemming from the company’s opioids products
  • Co-authored an amicus brief in the US Court of Appeals for the Fifth Circuit on behalf of the Fair Standards Alliance addressing application of antitrust law to firms seeking licenses to standard-essential patents on fair, reasonable, and non-discriminatory (FRAND) terms
  • Co-authored an amicus brief in the US Supreme Court on behalf of the US Chamber of Commerce regarding the proper mens rea for criminal liability
  • Co-authored an amicus brief in the US Supreme Court on behalf of a group of leading constitutional law scholars on the question of when Congress has the power to abrogate state sovereign immunity
  • Advised Meta (Facebook) on multiple issues involving the company’s legal risks, including over the use of arbitration clauses in its term of service and addressing possible violations of its “anti-scraping” provisions
