Mario Cuttone

Mario Cuttone is a member of the consumer class actions and products liability groups. He handles complex and class-action litigation for industry leaders in the pharmaceutical, automotive, and consumer electronics fields. Mario has wide experience in federal and state courts, including in multidistrict proceedings, and has worked on multiple high-profile trials.

Prior to joining O’Melveny, Mario was a law clerk at the United States Attorney’s Office for the District of Arizona.

  • Representing a major pharmaceutical company in multi-billion, multi-district litigation and nationwide state actions relating to the sale and marketing of prescription opioid pain medications
  • Defending a major automotive manufacturer against several putative class actions related to negligent design and consumer fraud claims
  • Defended against class certification in a multi-state putative class action, which involved extensive expert testimony on issues of engineering, marketing, and damages, ultimately resolving the case with favorable settlement
  • Successfully opposed the creation of an industry-wide MDL proceeding related to consumer fraud claims against industry-leading consumer electronics companies
  • Represented pharmaceutical company in Judicial Council Coordinated Proceeding alleging product liability claims; trial team obtained full defense verdict in first California trial
  • Secured dismissal of a putative nationwide class action against a leading construction and farming equipment manufacturer through early expert discovery
  • Conducted an internal investigation on behalf of a global ride-sharing service
