China’s Cyber Security Law: Can Foreign Parties Sue China’s Technology Companies for Violating the Law?

In his second article in a series about the new China Cyber Security Law, partner Ron Cheng discusses whether international businesses and individuals may use China’s Cyber Security Law mandates to seek relief for data breaches and other cyber security compromises. 

“The Law is not clear on these issues of civil liability, just as it is less than specific on a number of its data protection obligations... we can expect to see Chinese courts being asked to determine these important issues,” Cheng wrote.

Cheng handles both anti-corruption and data security and privacy matters and is co-located in O’Melveny’s Hong Kong and Los Angeles offices. He served for more than 22 years at the US Attorney’s Office for the Central District of California and as DOJ’s sole representative in the US Embassy in Beijing as Resident Advisor.
