The Below the Radar Boom in Co-Investments

O’Melveny partner Timothy Clark and counsel Alicja Biskupska-Haas co-authored the article, “The Below the Radar Boom in Co-Investments” published in the August 2017 edition of The Investment Lawyer. Sponsors always have offered co-investment opportunities to large investors, but investor demand for those opportunities has grown significantly over the last few years, the authors write. 

The article “provides a high-level overview of co-investments and the co-investment process, including structuring issues, benefits, and drawbacks of co-investing, commonly negotiated co-investment deal terms, certain regulatory considerations in co-investments, and current and anticipated trends in co-investing.”

Drawing on more than 20 years of experience in the investment fund sector, Clark advises clients in connection with fund formations and structuring transactions such as investment adviser mergers and acquisitions, and investments into private funds. Biskupska-Haas specializes in fund formation, operations, and compliance with securities laws. They both reside in O’Melveny’s New York office.
