Law360: The Common Issue In Mass Tort Consolidation

O'Melveny DC associate Scott Edson and partner Matthew Shors recently published a guest column in Law360, entitled, "The Common Issue in Mass Tort Litigation."  The article explores how constitutional due process prohibits courts from combining litigation in a way that deprives defendants of the ability to defend on case-specific issues.  It argues that courts considering aggregation techniques should first determine the anatomy of an individual claim, which will allow them to more realistically assess the implications of a given proposal.
