O’Melveny partner Anton Metlitsky will join the panel discussion, “Lucia v. SEC: Consequences of Expanding Judicial Appointment of Administrative Law Judges,” at the National Association of Women Judges 40th Annual Conference on October 4, 2018, in San Antonio, Texas.
The panel will discuss criteria to consider in appointment of administrative law judges (ALJs) and focus on the potential effects Lucia may have on both the appointment process and the removal power. The panel will also address the strategic considerations in litigating the case when the government would not defend the judgment, and the potential consequences of the court’s decision on the issue for non-ALJ executive branch positions.
