O'Melveny to Take Part in ABA's 2009 Global Business Forum

O'Melveny partners Shannon Lowry Nagle , Gerald Bender, Mark Fairbairn, and Nathan Bush will be speaking at the ABA Section of Business Law's 2009 Global Business Forum to be held June 10-12, 2009 in Hong Kong.

On June 11, Bender and Fairbairn will participate in a panel discussion moderated by Nagle, titled "What's Next? Emerging Trends in the Insolvency Laws and Restructurings of Distressed Companies in the Wake of the Global Crisis." The panel will review the trends emerging from the past year’s global economic meltdown, with a specific focus on how the results of major bankruptcy cases, lack of financing, and new regulatory changes will shape the restructuring of distressed companies in the future and workouts of troubled loans. The panel will also outline the legal strategies to consider when pursuing distressed M&A transactions, including asset dispositions from troubled companies, financial institutions restructuring their portfolios, and funds de-leveraging.

On June 12, Bush will be a panelist for "The New PRC Competition Law: North American Genie in a New Bottle?" The panel will provide an overview of the new PRC and contrast it with US and Canadian competition laws, highlight the implications for North American companies doing business in the PRC, and map out how to comply with the overlapping and conflicting competition laws for a multi-jurisdiction transaction. The panel will also provide insights into the pending Hong Kong competition laws.
