O’Melveny partners Benjamin Singer and Rebecca Mermelstein co-authored an article discussing a June memo from the Deputy Attorney General permitting the resumption of Foreign Corrupt Practices Act (FCPA) enforcement and whether the memo’s directives offer foreign individuals and companies a new avenue to defend against FCPA prosecution: claims that prosecutors are “selectively” prosecuting foreign defendants in violation of equal protection standards.
