The Trademarks Law Review
November 11, 2022
O’Melveny partner David Eberhart and counsel Andrew Levad are Contributing Editors for the sixth edition of The Trademarks Law Review. The key objectives of the publication include: providing practitioners with a snapshot capturing the current state of trademark law and its key provisions in major jurisdictions; analyzing recent litigation for insight into trends and developments in the law; and making informed forecasts of legal and legislative changes affecting trademark practice.
“New case law continues to blossom in the digital space that trademark practice increasingly occupies, resulting in significant developments in the fields of digital goods, online advertising and e-commerce,” they write in the Editors’ Preface. Eberhart’s and Levad’s chapter on the US trademark system considers both federal and state law, the registration of marks, civil litigation, potential USPTO refusals, and other enforcement proceedings. Read the full chapter of The Trademarks Law Review on the USA here.
