Malcolm Montgomery will join a panel reviewing current real estate loan workouts and enforcement. He serves as a trusted advisor to these and numerous other clients on the full range of real estate matters, including domestic and cross-border investment and finance, leveraged lending and bank finance for REITs and other real estate companies, workouts and restructurings of construction, permanent and mezzanine loans, and credit facilities. The panel discussion will cover:
- Loan workouts and restructurings in the non-CMBS context from counsel for the lender, counsel for the borrower and a litigator
- Current enforcement strategies being utilized in today’s market, including receiverships, transfer-in-lieu arrangements, foreclosures and suits under recourse guarantees
- How lender and borrower strategies may be affected by alleged violations of one-action laws, claims of clogging the equity of redemption and other enforcement defenses
