Recent Developments and Key Considerations in Consumer Finance False Claims Act (FCA) Litigation Webinar

O’Melveny and Berkeley Research Group (BRG) will host a webinar on “Recent Developments and Key Considerations in Consumer Finance False Claims Act (FCA) Litigation.” Corporations serving consumers and the general public under business arrangements with state and federal governments, and organizations operating in highly-regulated sectors involving government payments face increased scrutiny and exposure to claims initiated by state and federal governments, whistleblowers, and consumers for false claims submitted to government agencies and departments.

BRG directors Greg Halm and Paul Noring will be joined by O’Melveny partners David Leviss and Liz McKeen to discuss recent consumer finance-related FCA court rulings, the Department of Justice’s stance in consumer finance cases, the growing importance of expert consultants in establishing data compliance protocols and other effective strategies for limiting a company’s FCA liability exposure.

Greg Halm is a Managing Director in BRG’s San Francisco Bay Area office who advises clients in complex commercial disputes. He has substantial consulting experience on disputes in the consumer finance industry, where he specializes in advising clients in large-scale disputes involving significant amounts of data. He has supported both subject matter experts and damages experts.

David Leviss, a partner at O’Melveny, is a recognized authority on False Claims Act-related issues. He defends corporations and their key personnel from whistleblower qui tam actions under the False Claims Act, and civil and criminal enforcement actions based on the Anti-Kickback Statute and other statutes. David also represents corporations, institutions, and individuals in high-profile congressional investigations. Before joining O’Melveny, David served as a trial attorney with the Civil Fraud Section of the Department of Justice and was Chief Oversight Counsel to the US House of Representatives Committee on Energy & Commerce. At the DOJ and in private practice, David has investigated and litigated dozens of False Claims Act matters in federal courts nationwide, involving issues concerning Medicare Advantage, Part D, and Medicaid managed care, as well as defense procurement, defective pricing allegations, and federally insured mortgages and mortgage-backed securities.

Liz McKeen, co-chair of O’Melveny’s Financial Services Practice, represents mortgage lenders, servicers, banks, credit reporting agencies, and other financial services institutions in their most high-stakes matters. Liz handles complex civil litigation, including qui tam and other FCA matters and appeals, consumer class actions, and state and federal regulatory enforcement actions. In addition to litigation, Liz provides strategic regulatory and compliance counseling, with deep expertise in the areas of fair lending, consumer bankruptcy, mortgage origination and servicing, and foreclosure-related matters.

Paul Noring is a Managing Director out of BRG’s Washington DC Office who has provided extensive consulting and expert witness assistance to clients related to various consumer finance cases and regulatory matters. Prior to his tenure at BRG he led Navigant Consulting’s, Banking, Insurance & Capital Markets Practice, was a senior officer at Fannie Mae and a Partner at PricewaterhouseCoopers in the Banking & Capital Markets Group.
