The Federal Rule of Evidence (FRE) 702, which addresses expert testimony in federal court, was amended last month to establish when a judge should bar expert testimony from being presented to a jury. O'Melveny partner Rob Shaffer noted that the amendment is more of a clarification than a fundamental change. “But it certainly will have some impact,” Shaffer said.
