Greg Jacob, an O’Melveny partner and former counsel to Vice President Mike Pence, advised Pence a day before the Jan. 6 riot at the US Capitol that blocking or delaying the count of 2020 presidential electoral votes would violate the Electoral Count Act. Jacob also detailed former President Trump’s lawyer John Eastman’s attempt to overturn election results, saying that Eastman’s advice “functioned as a serpent in the ear of the president of the United States, the most powerful office in the entire world.” Jacob, who is scheduled to testify before the House Jan. 6 committee this week, handles Employee Retirement Income Security Act and labor and employment issues at O’Melveny.
