Bloomberg Law: American Flight Attendants Lose Age Bias Suit Over Covid Buyouts

Judge Beth Labson Freeman of the US District Court for the Northern District of California dismissed a lawsuit accusing American Airlines of age discrimination in employee retirement programs offered to flight attendants during the pandemic. “American did not have control over the volume of people willing to engage in domestic air travel or the disparate effects of COVID-19 on the older population generally, and thus those conditions cannot be ‘as a result of discrimination’ such that they amount to a constructive discharge,” Judge Freeman said.
