Bloomberg Law: Chicken Price-Fixing Case Ends in Mistrial After Seven Weeks12月 16, 2021
US District Judge Phillip Brimmer declared a mistrial in the US Department of Justice’s case against 10 poultry executives over their alleged role in price fixing chicken sold in restaurants, grocery stores, and elsewhere. Following a seven-week trial, jurors failed to reach a verdict after four days of deliberations. “It is not illegal for a competitor to obtain, rely upon, and act on pricing and other information received from competitors and others so long as there is no agreement to fix prices or rig bids,” O’Melveny partner Michael Tubach said, who represents former Pilgrim's Pride CEO Jayson Penn.
