Bloomberg Law: Supreme Court Curbs Warrantless Home Entry for Misdemeanors

O’Melveny special counsel Jeffrey Fisher was quoted in this Bloomberg Law article highlighting the US Supreme Court’s decision to favor “home protections against law enforcement entry” in Lange v. California. The Court ruled that that police are required to obtain warrants prior to entering private homes during misdemeanor pursuits, if there are no exigent circumstances.

Fisher successfully argued that evidence against Arthur Lange obtained when an officer followed him from the road into his garage without a warrant should be suppressed. 

“For hundreds of years, the warrant requirement has protected personal privacy and provided a means of assuring individuals that officers are acting lawfully,” Fisher noted following the ruling. “Warrants thereby honor the rule of law and help to avoid sometimes-tragic outcomes.”
