Cincinnati Enquirer: Sittenfeld Attorney Says Case Should Be Dismissed. Now It’s Up To A Judge

O’Melveny partner Michael Dreeben is leading the team representing Cincinnati City Councilman P.G. Sittenfeld in a case involving allegations of bribery, honest services wire fraud, and attempted extortion, this article reported.

At a recent hearing, attorneys for Sittenfeld argued that the allegations outlined in the indictment actually disprove the prosecution’s theory, and that the case should be thrown out.

Dreeben, a former deputy solicitor general for the US Department of Justice, said the prosecution’s case was undercut by the fact that Sittenfeld’s actions were not controlled by money. “There’s nothing unlawful about soliciting funds in a conversation in which [he’s] talking about what policies he favors,” Dreeben stated at the hearing.
