Federal regulators are clamping down on recent ransomware attacks, leading states to increase their own consumer privacy protections, Law360 reported.
The success of these efforts depends largely on whether state legislatures agree that consumers should be allowed to bring lawsuits; several such proposals are pending in Congress.
“The enhanced pressure on the federal government to address systemic cybersecurity threats could result in a range of measures, including reporting requirements being imposed by legislation or increased regulation in key critical infrastructure sectors like energy, water and transportation,” said O’Melveny data security and privacy counsel John Dermody.
