Daily Journal: US Companies Might Handle China Data Privacy Law Well

New Chinese data privacy laws pose compliance risks for multinational companies, though recent GDPR and CCPA regulations in Europe and California, respectively, have boosted corporate competencies with respect to global data protection regulations, this article reported.
O’Melveny special counsel Scott Pink told the Daily Journal that the Chinese law, which “forbids the transfer of data in China to any foreign judicial bodies or law enforcement agencies without the approval of a Chinese government entity,” could pose a threat to cross-border litigation.
“I think that’s a provision that could make it more difficult to transfer data out of China in response to those kinds of law enforcement or governmental orders,” Pink said. “It is a little less clear whether it applies to civil discovery … but I think that’s going to have to be really focused on how is that going to impact litigation involving personal data in China.”
