Forward Kentucky: KYGA Overrides HB 3 Veto; Planned Parenthood and ACLU to Sue

Planned Parenthood and the American Civil Liberties Union (ACLU) filed two lawsuits challenging H.B. 3, a Kentucky anti-abortion law that bans abortion in the state as of April 13, 2022. Governor Andy Beshear vetoed the legislation on April 8 and the legislature overrode the veto, effectively eliminating abortion access in Kentucky. The suits argue that the law “would create unnecessary abortion requirements while simultaneously making those requirements impossible to comply with given the immediate effective date of the law, forcing providers in the state to stop offering abortion services.” The suit also contends that the law violates patients’ federal right to abortion under Roe v. Wade. The ACLU’s challenge was made on behalf of EMW Women’s Surgical Center, which is also represented by O’Melveny & Myers LLP.
