Law Week Colorado: Defendants Acquitted in Antitrust Trial Over Poultry Prices

Former Pilgrim’s Pride CEO Jayson Penn and other chicken industry executives were found not guilty of price fixing charges following the US Department of Justice’s third attempt to convict them. “I think we were able to get people to trust each other,” said Michael Tubach, who represented Penn. Anna Pletcher, who also defended Penn, noted how surprised she was that the case was brought in the first place. “What we learned when our client was indicted is that very little investigation had gone on,” Pletcher said. “The result of that was the government charged a case they shouldn’t have charged. They charged 10 innocent men because they failed to investigate properly and that’s a big part of this story.”
