Law360: 4th Circ. Won’t Reconsider American Airlines Pilot’s Award

The Fourth Circuit ruled that a Virginia district court awarded the correct amount of damages and costs to Maj. Gen. Thomas Harwood III after he sued American Airlines for violating the Uniformed Services Employment and Reemployment Rights Act. Harwood, who rejected the deal, claimed that he was not properly reinstated after returning from military leave. “As long established, district courts are best positioned to make factual determinations concerning warranted damages and the need for costs and fees,’ US Circuit Judge Henry F. Floyd wrote. “In the case before us, we find no reversible error.” American Airlines is represented by Anton Metlitsky and Jason Zarrow of O’Melveny & Myers LLP.
