Law360: 4th Circuit Declines to Rehear Auto Action’s COVID-19 Case

A Fourth Circuit panel on Tuesday denied a Maryland car auction company’s request for a rehearing, affirming a Chubb unit’s escape from a coverage claim for COVID-19 business losses. The Fourth Circuit found that a Maryland federal court was correct in finding that the virus did not physically alter Bel Air Auto Auction’s property, and not being able to use it wasn’t the physical damage necessary to trigger coverage by Great Northern Insurance Co.
