Cryptocurrency enforcement and regulatory actions are expected to be in full effect in 2023 following the collapse of FTX. “No question — this is going to be a year of crypto prosecutions,” said O’Melveny & Myers LLP partner Rebecca Mermelstein, who is former federal prosecutor for the Southern District of New York. Mermelstein noted that there will be two categories in which actions will be taken: crypto-specific cases and classic white collar fraud with a “crypto flavor.”
