Law360: BREAKING: Justices Hand Win To Austin In Digital Billboard FightApril 21, 2022
The US Supreme Court ruled in favor of the city of Austin, Texas, saying that its law regulating the location of digital billboards is not a content-based restriction. The justices ruled 6-3 that the city’s regulation “is ‘agnostic’ as to content, and therefore doesn’t warrant strict scrutiny.” Today’s ruling overturns a 2020 decision by the Fifth Circuit.
