Law360: Employer Groups, Insurers Fight For ‘No Surprises’ Law

The Blue Cross Blue Shield Association filed an amicus brief in the US Court of Appeals for the Fifth Circuit supporting the US Department of Health and Human Services and the US Department of Labor’s case challenging a February ruling by US District Judge Jeremy D. Kernodle. The decision ordered the agencies to find a different way of enforcing the No Surprises Act, a medical billing law passed in late 2020. “Private-equity firms acquiring physician practices have focused ‘heavily in emergency medicine staffing companies and the ancillary hospital-based specialties that have been able to leverage out-of-network balance billing as a profit strategy,’” the Blue Cross group said.
