Law360: FDA Graphic Cigarette Warnings Go Up In Smoke

US District Judge J. Campbell Barker granted summary judgement to a group of tobacco companies in their case against the US Food and Drug Administration, vacating a rule that would have required them to display graphic health risk warnings on cigarette packages. “The government has not shown that compelling these large, graphic warnings is necessary in light of other options,” Judge Barker said. R.J. Reynolds, ITG Brands, Liggett Group, and other tobacco retailers sued the FDA in 2020 to block the rule, which they claim is unconstitutional. Liggett Group is represented by Meaghan VerGow and Scott Harman-Heath of O’Melveny & Myers LLP.
