Law360: Hill’s Dog Food MDL Judge Tosses German Buyer’s Suit

US District Judge Julie A. Robinson dismissed a proposed class-action accusing Hill’s Pet Nutrition and its parent company Colgate-Palmolive of breaching warranty under the Magnuson-Moss Warranty Act. The suit alleged that Hill’s pet food, which was recalled in January 2019, contained dangerous amount of vitamin D and led to serious health conditions for pets. Judge Robinson said that that the act’s broad definition of “commerce” implies “boilerplate” language and “isn’t enough to overcome the presumption against extraterritoriality.” The defendants are represented by Richard B. Goetz and Hannah Y. Chanoine of O’Melveny & Myers LLP.
