Law360: Justices To Mull Limits Of Fraud In NY ‘Buffalo Billion’ Cases

The US Supreme Court agreed to hear a case involving construction executive Louis Ciminelli, who was sentenced to more than two years in prison following claims that he schemed to defraud taxpayers in the New York state-funded “Buffalo Billion” projects. The court will consider the “right-to-control” theory and whether the government can prevail without proving an intent to cause economic harm. “Our team is gratified that the Supreme Court has agreed to hear Mr. Ciminelli’s case, which will allow the court to address our challenge to the validity of the right-to-control theory used in the prosecution,” said O’Melveny partner Michael R. Dreeben, who represents Ciminelli along with Kendall Turner and Jenya Godina.
