Law360: SG Flips High Court Stance On Scrutiny In Donor Privacy Row

O’Melveny partner Michael Dreeben spoke with Law360 about the Biden administration’s recent about-face regarding a California law concerning charities, their big ticket donors, and tax disclosure. 

Dreeben told the publication that the recent reversal was built on sturdier legal footing than the previous Solicitor General’s initial position in November 2020.  “I think that the Trump administration's brief seemed to be ideologically driven, and the current brief that the Biden administration has filed does not,” he said, adding that the new opinion holds “a traditional institutional respect for a coordinate government.”

“I think what we are seeing here is a welcome willingness to revisit positions that were extreme and unfounded,” Dreeben concluded.
