Law360: Sun Can’t Say Allergan Used Secret Info To Grow Patent Suit

US District Judge Richard Andrews dismissed claims brought by Sun Pharmaceuticals accusing AbbVie unit Allergan of unlawfully using Sun’s ANDA product formulation to add a patent in litigation against Sun over the irritable bowel syndrome drug Viberzi. “Sun does not allege, nor does it provide any facts to support the inference, in its amended answer that Allergan inferred details about the Sun ANDA formulation through the public aspects of this litigation,” Judge Andrews wrote. Allergan is represented by Lisa Pensabene of O’Melveny & Myers LLP.
