O’Melveny & Myers LLP partner Michael R. Dreeben, who has argued over 100 cases at the US Supreme Court and formerly served as deputy solicitor general, said that oral arguments at the high court following the pandemic have switched to a hybrid model that includes a two-minute opening from advocates as well as the more regimented, serial questioning used during remote arguments last term. “It has a tremendous effect on how advocates prepare,” Dreeben said. “We had to be prepared to deliver a synthesized argument in a compressed form knowing that we would not be interrupted.” O’Melveny lawyers achieved wins in all three of the cases they argued before the justices this term.
