Planned Parenthood: Kentucky Legislature Overrides Governor’s Veto, Planned Parenthood and ACLU to Sue to Block Law’s Unconstitutional Abortion Restrictions

Planned Parenthood and the American Civil Liberties Union (ACLU) filed two lawsuits against the state of Kentucky over H.B. 3, an anti-abortion law that effectively bans abortions in the state. The state's legislature overrode Governor Andy Beshear’s April 8 veto of the law, immediately putting a 15-week abortion ban into effect. The suits contend that the law would pile on “a laundry list of unnecessary abortion restrictions that are impossible for providers to comply with because the Commonwealth has not yet set up the mechanisms for complying with the law.” They also argue that law violates patients’ federal right to abortion under Roe v. Wade. The ACLU’s challenge was made on behalf of EMW Women’s Surgical Center, which is also represented by O’Melveny & Myers LLP.
