Reorg: Brazos Electric Provides Overview of Potential Securitization Structure at Status Conference

Brazos Electric Power Cooperative Inc., which is facing a US$1.9 billion claim from the Electric Reliability Council of Texas (ERCOT), touched on various parts of its Chapter 11 plan process. Brazos’ counsel, Lou Strubeck of O’Melveny & Myers LLP, told the court Brazos is considering four or five different exit options and is considering whether to retain an advisor to estimate the value of its assets. Strubeck also argued that any effort to market Brazos’ assets constitutes an event of default.
