The National Law Journal: ‘A Serpent in the Ear of the President’: Mike Pence’s Counsel, Now at O’Melveny, Confronted John Eastman Over Jan. 6 Legal Theory

An email conversation between Greg Jacob, former chief counsel to Vice President Mike Pence, and John Eastman, a conservative constitutional law professor representing former President Donald Trump, details Eastman’s attempt to convince Jacob that Pence had legal authority to reject electors following the 2020 Presidential election. “I have run down every legal trail placed before me to its logical conclusion, and I respectfully conclude as a legal framework, it is a results oriented position that you would never support if attempted by the opposition, and essentially entirely made up,” Jacob wrote to Eastman. The exchange was made public by the House Jan. 6 committee and also included Jacob telling Eastman that his advice “functioned as a serpent in the ear of the president of the United States.”
