O’Melveny partner and chair of the firm’s General Litigation Practice David Marroso authored this article discussing settlement demands. “What the standard should be, and which of these cases is 'right,' are beyond the scope of this article,” Marroso wrote. “Our concern is that the uncertainty and shifting legal landscape creates massive risk for lawyers who, in service of their clients, may become defendants in significant litigation. Zealous advocacy could be stifled to the detriment of clients on both sides of the ‘v.’ The opportunity for the Legislature to step in and clarify the rules that govern attorney conduct is more ripe than ever.”
