The Texas Lawbook: Litigation Roundup: Planned Parenthood Moves to Toss $1.7B Medicaid Fraud Suit

January 9, 2023

Planned Parenthood asked US District Judge Matthew J. Kacsmaryk to grant summary judgment and dismiss claims that it defrauded Medicaid through reimbursements from birth control and other services. “Plaintiffs’ reverse-false-claims theory is that defendants improperly failed to repay government funds they had received from Medicaid,” Planned Parenthood argued. The state of Texas intervened in the lawsuit, which was brought by “Alex Doe,” and claimed that Planned Parenthood received US$10 million from Medicaid services over a 4-year span. Planned Parenthood is represented by Danny S. Ashby, Amanda Santella, Craig Bloom, Justin Chapa, Megan R. Whisler, Ross Galin, and Leah Godesky of O’Melveny & Myers LLP.
