The Wall Street Journal: Supreme Court Puts New Limits on Fraud Prosecutions

The US Supreme Court reversed the conviction of real estate developer Louis Ciminelli, who was accused of bid rigging a contract related to the “Buffalo Billion” project. The high court determined that the “right to control” theory, which was used as the basis for Ciminelli’s conviction, was invalid. “We are gratified by the Supreme Court’s unanimous holding today that the government’s theory of prosecution of Louis Ciminelli was invalid, root and branch,” said Michael R. Dreeben, Ciminelli’s lawyer.
